Absalom's Trial:
Johannes Pafuri on stand.
Judge: We bring forward a witness to the occasion, of the death of Aurther Javris.
Opposing Lawyer: Where were you the night of Mr. Jarvis' death?
Johannes Pafuri: With Absalom Kumalo and Matthew Kumaol..., at the home of Aurther Jarvis.
Opposing Lawyer: What was your purpose at the home of Mr. Jarvis?
Johannes Pafuri: It was an intended robbery.
Opposing Lawyer: Did this "intended robbery" go as planned?
Johannes Pafuri: No, no it did not.
Opposing Lawyer: What occurred that changed the plan?
Johannes Pafuri: A man was killed.
Jury: (Gasps and Talking)
Judge: Order, Order! Order in the court.
Opposing Lawyer: Did you plan this out, the murder of Aurther Javis?
Johannes Pafuri: No planning that I was aware of.
Opposing Lawyer: Could Mr. Kumalo have planned it on his own? Did you discuss what would happen that night thoroughly before you went to Mr. Jarvis' house?
Johannes Pafuri: We spoke about it, not a lot. We had a very general plan. Not many details.
Opposing Lawyer: So Absalom may have planned the murder in secret.
Johannes Pafuri: That could be so.
Opposing Lawyer: That is all. Thank you your honor.
Mr. Carmichael: Some of you may be thinking the choice is clear, you may think Mr. Kumalo is guilty of murder. Have you ever been scared for your life? Have you ever been in a life threatening situation? Mr. Kumalo is a very inexperienced man in the field of murder. Perhaps he was scared and pulled the small trigger, not worried about anything, but his safety. The man was not brutally killed, it was only one shot.
Opposing Lawyer: Objection!
Judge: Sustained.
Mr. Carmichael: If Mr. Absalom had made up his mind that he wanted to kill Mr. Jarvis, he may have done it in a sneakier, harsher way. He shows regret and is very sorry. His condolences and mine to Mr. James Jarvis.
Opposing Lawyer: Objection irrelevant to the case!
Judge: Sustained.
Mr. Carmichael: I do believe it was not planned, it was a abrupt action that took place out of fear. Was Mr. Jarvis even supposed to be involved, Mr. Pafuri?
Johannes Pafuri: No sir, it was poorly planned.
Mr. Carmichael: That is all. Much obliged.
Judge: If that is all from the defendant and prosecutor, I would like to welcome Mr. Matthew Kumalo to the stand.
